Changes to Open Work Permits for Family Members of Temporary Residents: What You Need to Know

As Canada continues to refine its immigration policies to align with economic goals and labor market needs, significant updates to the Open Work Permit (OWP) eligibility criteria for family members of international students and foreign workers have been announced. Effective January 21, 2025, these changes aim to bolster the integrity of Canada’s temporary resident programs while addressing workforce priorities.

Key Updates to Open Work Permit Eligibility

The updated criteria focus on narrowing the eligibility for family OWPs, limiting the scope to spouses of individuals in specific academic and occupational categories. Here are the major changes:

1. Eligibility for Spouses of International Students

Spouses will only be eligible for a family OWP if the principal applicant is enrolled in one of the following:

  • Master’s programs that are 16 months or longer.
  • Doctoral (PhD) programs.
  • Select professional or other eligible programs (a detailed list will be provided by IRCC).

2. Eligibility for Spouses of Foreign Workers

Spouses of foreign workers can apply for a family OWP only if the principal applicant is employed in:

  • TEER 0 or 1 occupations (high-skilled jobs such as managers and professionals).
  • Select TEER 2 or 3 occupations in sectors facing labor shortages or linked to government priorities, including:
    • Natural and applied sciences
    • Construction
    • Health care
    • Natural resources
    • Education
    • Sports
    • Military

3. Work Permit Duration Requirement

To qualify, the foreign worker must have at least 16 months remaining on their work permit at the time of the spouse’s application.

4. Dependent Children’s Eligibility

Dependent children of foreign workers will no longer be eligible for a family OWP under these changes.

Transition Measures and Renewals

Work permits approved under the previous rules will remain valid until their expiration. To provide flexibility, IRCC has outlined renewal options for in-Canada family members:

  • Renewals are allowed if they meet the same criteria as the current permit.
  • The duration of the renewed permit must match the validity of the principal applicant’s study or work permit.

Exceptions to the Changes

Some groups remain unaffected by these new rules:

  • Spouses of workers covered by free-trade agreements.
  • Family members of individuals transitioning to permanent residence.

Family members no longer eligible for a family OWP can explore other work permit options under Canada’s work permit programs.
